General conditions of sale 2447993 Alberta Ltd. as known as "The Real Jenny McCarthy"

Article 1: Scope of application

These general conditions of sale apply to all transactions concluded through the websites of  2447993 Alberta Ltd. or as otherwise known as "Jennifer McCarthy" or "The Real Jenny McCarthy" is considered as "client" any natural or legal person making with the company 2447993 Alberta Ltd. on order validated via our secure payment platform, or by cheque or cash.

Article 1a: Age limit

Age restrictions apply: The company 2447993 Alberta Ltd. only accepts clients over 16 years old (for physical and electronic products) and over 18 years old (for services: coaching, workshops, seminars). We do our best to restrict access to our sites, products and services to minors. Even if the content of our products and services is not of a shocking nature, we prefer to target a mature audience capable of understanding the implications and responsibilities of the business world. Any subscriber to the newsletter who does not meet these criteria (age over 16) will be immediately deleted from our database as soon as this is brought to our attention. Likewise, any customer who does not meet these criteria will be immediately reimbursed and a return of the product (s) concerned will be required.

Article 2: Order

Any order placed on a site belonging to the company 2447993 Alberta Ltd. implies full and unreserved acceptance of these general conditions of sale.

Article 3: Price

The prices are indicated in Canadian Dollars all taxes included (at the rate of 5% GST as per the province of Alberta), excluding shipping and processing of your order. The price of items can be changed at any time. However, the price applied to an order that will be announced at the time of the order.

Article 4: Membership Terms & Payment

4.1 Payment is due immediately on the date of the order, including for pre-order products. You can pay by credit card. Cards issued by banks domiciled outside Canada must be international bank cards (Mastercard or Visa). We do not accept American Express. Secure online payment by credit card is made through the company Stripe. The information transmitted is encrypted by software in the rules of the art and cannot be read during transport over the network. Any guarantee as to the security of this system is entirely the responsibility of the company Stripe and cannot be attributed to us.

4.2 Automatic Renewal - Your membership will automatically renew at the end of each billing cycle unless you cancel.

4.3 Payment Options - Payment options are pay in full (PIF) for annual agreements or monthly payment options that may be available from time to time. Monthly payment options are subject to a three (3) month committment do to the nature of the content delivered. After the commitment period you may cancel the membership if you feel it is not for you. See the cancellation clause.

Article 5: Delivery

Delivery is made to the address or email address you specified when placing your order (therefore, pay particular attention to the spelling of the address you enter and especially the postal code). The risks will be your responsibility from the date on which the ordered products have left our premises. However, in the event of a lost package, we will do everything necessary so that you still receive your product or that you are reimbursed according to your warranty.

Article 6: Protection of personal data

In accordance with the Data Protection Act of 6 January 1978, you have the right to access and rectify personal data concerning you. We declare all of our files to the National Commission for Data Protection. By adhering to these general conditions of sale, you acknowledge having read our personal data protection policy and consent to our collection and use of this data. By entering your email address on one of our network sites, you will receive emails containing information and/or promotional offers concerning products published by the company 2447993 Alberta Ltd. or by other partners. You can unsubscribe at any time. You just have to click on the link at the end of our emails. This link is preceded by the words “To unsubscribe or change subscriber options visit:” (understand: to unsubscribe or change your registration options, click below).

Article 7: Access & Membership

Membership is individual and non-transferable. Participants are responsible for maintaining the confidentiality of their account credentials.  The company 2447993 Alberta Ltd. reserves the right to terminate or suspend access in the event of a breach of these terms.

Article 8: Refund Policy

All sales are final and non-refundable. 

Article 9: Intellectual Property 

All intellectual property rights related to the training content, including but not limited to videos, documents, and instructional materials, remain the exclusive property of 2447993 Alberta Ltd. Participants may not reproduce, distribute, or use any intellectual property from 2447993 Alberta Ltd. without explicit written consent from 2447993 Alberta Ltd.

Article 10: Termination and Cancellation

2447993 Alberta Ltd. reserves the right to terminate or suspend a participant's access for any violation of these terms and including violation of usage restrictions, sharing of login credentials, harassment or bullying of other members or non-payment immediately with no reimbursement.

Members may terminate their membership by cancelling through the membership area in the community app, or emailing - support@therealjennymccarthy.com.

Upon receiving a cancellation request, the next billing cycle will be cancelled within 2 business days for the next billing period. An email confirmation of the cancelation will be sent to the client and the client will maintain access until the end of the current billing period.

Article 11: Modification of Terms

2447993 Alberta Ltd. may update these terms and conditions without prior notice. Continued use of any content from 2447993 Alberta Ltd. constitutes acceptance of the updated terms.

Article 12: Governing Law

These terms and conditions are governed by the laws of Alberta, Canada

Article 13: Disclaimer 

Participation in 1-on-1 coaching, membership groups, and courses or any products by 2447993 Alberta Ltd. is at the participant's own risk. 2447993 Alberta Ltd. does not guarantee specific outcomes or results from the training.

All products are intended for educational and entertainment purposes only and should not be considered as professional advice. The products are a reflection of our own experiences and it is recommended to seek advice from professionals when needed.

The Company makes no guarantees about specific results or income potential from any products. The Company is not liable for any damages or losses resulting from use of membership content or participation in the program.
